Do I Have Legal Grounds To Demand A Refund When On The Receipt There Is No Return Policy?

By Jeff Frank

The “no return” policy is probably based on state regulations that forbid the resale of “used” bedding.

If the mattress has already been shipped, then the Mattress company has already incurred costs.

  • They may permit you to return the mattress if it is unused and if you are willing to reimburse them for the shipping costs (both ways.)
  • They may also require an additional restocking charge.

There is probably no legal obligation for them to do this, but if you make a friendly request, they may be willing to help.

I am not qualified to offer legal advice, but if I was in your position I would check to see whether there was any written documentation, that you relied on prior to the sale, that contradicts the “no return” policy stated on the receipt.
